CAP Comment to NIST Advocates for Artificial Intelligence Mitigation To Include Third-Party Deployment

The Center for American Progress submitted a response to the National Institute for Science and Technology’s plan for mitigating the misuse of artificial intelligence.

On September 9, 2024, the Center for American Progress submitted a response to the National Institute for Science and Technology’s (NIST) “Request for Comments on the U.S. Artificial Intelligence Safety Institute’s Draft Document: Managing Misuse Risk for Dual-Use Foundation Models.

In October 2023, the Biden-Harris administration issued the “Executive Order on the Safe, Secure, and Trustworthy Development and Use of Artificial Intelligence,” which included landmark directives for artificial intelligence (AI) safety and equity. NIST established the U.S. Artificial Intelligence Safety Institute to help fulfill the promises of the executive order on AI. To that end, NIST’s draft document outlines seven objectives to manage the misuse of AI.

CAP’s comment letter provides insight into these proposed practices and highlights further areas for mitigation. Much of the comment was based on CAP’s February 2024 report, “Generative AI Should Be Developed and Deployed Responsibly at Every Level for Everyone,” which details numerous recommendations for generative AI developers utilizing APIs that allow third-party deployments.

CAP commends NIST for this step toward mitigating the misuse of AI and recommends that before implementing this guidance, NIST should develop third-party-specific safety recommendations for each of its objectives.
