STATEMENT: CAP President Neera Tanden on Today’s Oral Arguments in King v. Burwell

Washington, D.C. — Center for American Progress President Neera Tanden issued this statement following the Supreme Court oral arguments in King v. Burwell. A ruling against the Affordable Care Act, or ACA, would be devastating to the health care system in states across the country and cause nearly nine million people to lose their support and thereby lose their coverage.

From the outset, this lawsuit has been yet another political move by conservatives to gut the Affordable Care Act, and today, they attempted to co-opt the Supreme Court into their scheme. The law is clear, and it is working, and tax credits should be available to all Americans who need them to have affordable health care. A bad ruling in the King v. Burwell case would affect millions of Americans, with nearly 9 million people immediately losing their access to care. Many of the justices must understand that both the legal context and the consequences of their ruling matter a great deal to the millions of Americans who rely on the ACA. While it may not be surprising that conservatives would continue their effort to strip health coverage from millions, it would be unconscionable for the Court to go along with the plaintiffs’ political arguments at the expense of so many.
