El 16 de agosto de 2023, la Corte de Apelaciones del Quinto Circuito de Estados Unidos emitió un nuevo fallo en el litigio en curso sobre la aprobación de la mifepristona. Si se permite que entre en vigor, la decisión del Quinto Circuito efectivamente haría retroceder el reloj regulatorio, y los correspondientes años de consenso médico reflejados en el proceso de toma de decisiones de la FDA, para restablecer restricciones a la mifepristona que dificultarían su acceso.
Por ahora, el acceso a la mifepristona permanece igual y está disponible en los estados donde el aborto es legal. Ahora toda la atención se centra en la Corte Suprema, que determinará los próximos pasos en este desafío legal infundado sobre el acceso al aborto con medicamentos.
