CAP Comment Letter on the EEOC’s Proposed Removal of Reporting Requirements

The Center for American Progress submitted a comment on the U.S. Equal Employment Opportunity Commission’s proposed rescission of reporting requirements.

On August 24, 2026, the Center for American Progress submitted a comment letter to the U.S. Equal Employment Opportunity Commission (EEOC) in response to the proposed rescission of EEO-1 through EEO-6 reporting requirements, as well as the recordkeeping and record preservation rules under 29 C.F.R. Part 1602. The comment letter describes CAP’s research examining the importance of the EEO-1 data collection. The letter also provides insights into, and examples of how, the EEO-1 data have been used by researchers and the EEOC for enforcement purposes and explain why collection is not a substantial burden to employers or the agency. Finally, the letter urges the EEOC to maintain the data collection because rescinding it would have a detrimental effect on the agency’s ability to detect discrimination and perform its enforcement obligations under federal law.
