STATEMENT: Corner Post Ruling Jeopardizes Thousands of Rules That Protect Consumers

Washington, D.C. — Today, the U.S. Supreme Court ruled that companies can challenge the validity of federal regulations no matter how long they have been in place, making it easier for businesses to undo long-standing rules that have protected consumers for decades. In response, Devon Ombres, senior director for Courts and Legal Policy at the Center for American Progress, issued the following statement:

We agree with Justice Ketanji Brown Jackson. The court’s ruling in this case, along with Friday’s Chevron decision, will “devastate the functioning of the Federal Government.” These rulings put in jeopardy thousands of regulations adopted over decades, opening the door to nonstop legal challenges for rules that have protected Americans from bad actors and corporate malfeasance for decades. The court overturned decades of precedent by holding that newly created businesses can challenge the legitimacy of any federal regulation, regardless of whether it was finalized 50 days ago or 50 years ago. Shell companies propped up by right-wing interests will be lining up to try to overturn rules that have been in place to protect vulnerable consumers for generations.

This is yet another instance of the right-wing justices on the Supreme Court putting politics and ideology ahead of the rule of law. This Supreme Court is openly embracing a right-wing anti-government agenda to allow the powerful to trample the rights of the people.
