Washington, D.C. — Today, the U.S. Supreme Court ruled 5–4 that the Trump administration could continue to deport Venezuelan migrants under the Alien Enemies Act. In response, Devon Ombres, senior director for Courts and Legal Policy at the Center for American Progress, issued the following statement:
The Supreme Court has again rewarded the Trump administration’s lawlessness after it callously condemned more than 100 Venezuelans to a Salvadoran gulag without the oppotunity to challenge their expulsion. The justices should have left in place the order temporarily halting this dangerous process while the lower court conducted fact-finding to prevent more people from being swept up—some by mistake—and removed by fiat. The majority’s fig leaf that future removals must be carried out with notice and an opportunity for individual challenges does nothing to assuage very real concerns that the Trump administration will continue to find new ways to abuse and hide behind its claimed authority under the Alien Enemies Act. This decision further weakens the rule of law for all Americans.
