Reproductive Rights, the Trump Administration, and the Supreme Court

Join the Center for American Progress for a virtual event featuring leaders and experts discussing major cases before the U.S. Supreme Court that could have an impact on reproductive health, rights, and justice. Leading experts will discuss relevant cases and how the Trump administration’s judicial nominations pose a threat to women, LGBTQ people, and people of color.

The Supreme Court heard a number of major cases this term that will have implications for reproductive health, rights, and justice. Three major issues at stake include whether meaningful access to abortion care will be gutted in Louisiana and across the country in June Medical Services v. Russo; whether employers and universities have broad discretion to deny birth control coverage under the Affordable Care Act in Trump v. Pennsylvania; and whether the protection against sex discrimination in Title VII of the Civil Rights Act of 1964 prevents discrimination against LGBTQ people in Harris Funeral Homes v. Equal Employment Opportunity Commission and related cases.

These cases, while each significant in their own right, are rarely discussed together for their collective potential to erode meaningful access to reproductive rights in the United States, particularly for women of color and other groups whose access to reproductive health and rights is most at risk. The cases were heard by a Supreme Court whose balance has been tipped to a majority that reflects the conservative strategy to appoint ideological, political judges throughout the judiciary.
